1. Introduction & Acceptance

Welcome to CollectDXB. These Terms of Service ("Terms") govern your access to and use of the CollectDXB website located at collectdxb.com, including all related services, features, content, and applications (collectively, the "Platform"). CollectDXB operates as a luxury goods consignment and e-commerce marketplace based in Dubai, United Arab Emirates.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and CollectDXB.

We reserve the right to refuse service to anyone for any reason at any time. Your use of the Platform is also subject to all applicable local, national, and international laws and regulations.

2. Account Terms

To access certain features of the Platform, including purchasing, selling, and consigning items, you must create an account. When registering, you agree to the following:

You must be at least 18 years of age to create an account and use the Platform.
You must provide accurate, current, and complete information during registration and keep your account information up to date at all times.
You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account.
You must notify CollectDXB immediately of any unauthorized use of your account or any other breach of security.
You may not use another person's account without their express permission and without CollectDXB's consent.
CollectDXB reserves the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms or engaged in fraudulent or suspicious activity.

3. Products & Purchases

CollectDXB offers a curated selection of luxury goods, including but not limited to watches, handbags, jewellery, and accessories. All product descriptions, images, and specifications are provided in good faith and are intended to be as accurate as possible.

All prices displayed on the Platform are denominated in AED (UAE Dirhams) unless otherwise explicitly stated.
Product availability is not guaranteed. Items may be sold, reserved, or removed from listing at any time without prior notice.
The placement of an order does not constitute acceptance. CollectDXB reserves the right to accept or decline any order at our sole discretion, including after payment has been received.
In the event an order is declined or an item becomes unavailable after purchase, you will receive a full refund of the purchase price.
While we strive for accuracy, slight variations in colour, texture, or appearance may occur between product images and actual items due to photography, lighting, and screen display differences.

4. Payment Terms

All payments on the Platform are securely processed through Stripe, our third-party payment processor. By making a purchase, you agree to the following payment terms:

Accepted payment methods include major credit and debit cards (Visa, Mastercard, American Express) and other methods supported by Stripe in your region.
All prices are displayed and charged in AED (UAE Dirhams) unless an alternative currency is explicitly selected. Currency conversions, if applicable, are handled by your card issuer and may include additional fees.
You are responsible for any applicable taxes, duties, customs charges, or import fees that may arise from your purchase, particularly for international orders.
Payment is collected at the time of order placement. Your order will not be processed until payment has been successfully authorised and captured.
CollectDXB does not store your full payment card details. All sensitive payment information is handled directly by Stripe in accordance with PCI-DSS compliance standards.

5. Shipping & Delivery

CollectDXB ships luxury goods within the United Arab Emirates and to select international destinations. All shipments are fully insured and tracked.

Risk of loss or damage to items passes to the buyer upon successful delivery and signature confirmation.
Estimated delivery times are provided for informational purposes only and are not guaranteed. Delays may occur due to customs processing, courier availability, or other factors beyond our control.
A signature is required upon delivery for all orders. If you are unavailable to sign, the courier may attempt redelivery or hold the package at a designated collection point.
Shipping costs, if applicable, will be displayed at checkout before you complete your purchase.
CollectDXB is not responsible for delays caused by incorrect or incomplete shipping addresses provided by the buyer.
International buyers are solely responsible for any customs duties, import taxes, or brokerage fees imposed by their country of destination.

6. Returns & Refunds

CollectDXB offers a 14-day return window from the date of delivery, subject to the following conditions:

Items must be returned in their original condition, unworn, undamaged, and with all original packaging, tags, certificates, and accessories included.
The buyer is responsible for the cost of return shipping. We recommend using a tracked and insured shipping service, as CollectDXB is not liable for items lost or damaged in return transit.
Refunds will be processed within 5 to 10 business days of receiving and inspecting the returned item. Refunds are issued to the original payment method.
The following items are non-returnable: custom or bespoke orders, personalised items, items that have been worn or altered, and items returned without original packaging or documentation.
CollectDXB reserves the right to refuse a return if the item does not meet the conditions stated above. In such cases, the item will be returned to the buyer at their expense.

7. Consignment Terms

CollectDXB offers a consignment service for sellers who wish to list their luxury items on our Platform. By submitting an item for consignment, you agree to the following:

Submission & Authentication

All items submitted for consignment must be authentic. Submitting counterfeit goods is strictly prohibited and may result in account termination and legal action.
Every consigned item undergoes a thorough authentication process by our certified specialists before it is listed on the Platform.
CollectDXB reserves the right to reject any item that does not meet our quality, authenticity, or market suitability standards.

Commission & Pricing

CollectDXB operates a tiered commission structure. The applicable commission rate will be communicated to you before your item is listed and is based on the item's category, value, and market demand.
The listing price is agreed upon between CollectDXB and the seller prior to the item being made available on the Platform. CollectDXB may recommend pricing adjustments based on market conditions.

Listing & Sale

Consigned items will be listed on the Platform for an agreed duration. If an item does not sell within the listing period, CollectDXB will contact the seller to discuss options, including price adjustments, extended listing, or return of the item.
Upon successful sale, seller payouts are processed within 3 to 5 business days, less the applicable commission.

Insurance & Care

All items are insured while in CollectDXB's possession during the consignment period. Coverage is limited to the agreed listing price of the item.
CollectDXB exercises reasonable care in handling, storing, and photographing consigned items but is not liable for normal wear associated with handling and inspection.

8. Sell Request Terms

If you wish to sell your luxury item directly to CollectDXB rather than consigning it, you may submit a sell request through the Platform. The following terms apply:

Submit your sell request with clear photographs and detailed descriptions of the item, including brand, model, condition, and any relevant documentation (receipts, certificates, boxes).
CollectDXB will review your submission and provide an offer within 48 hours of receipt.
Offers are valid for 7 days from the date of issuance. After this period, the offer may be revised or withdrawn.
The item must match the description and photographs provided when it is received by CollectDXB. If there are material discrepancies, the final price may be adjusted following an in-person inspection.
Upon acceptance of the final price, payment will be processed within 3 to 5 business days via your preferred payment method.
CollectDXB reserves the right to decline any sell request at our sole discretion, including after in-person inspection if the item does not meet our standards.

9. Authentication & Condition

CollectDXB is committed to ensuring the authenticity and quality of every item sold on our Platform.

All items are authenticated by our team of certified specialists using industry-standard techniques, tools, and reference materials.
Items are graded according to the following condition scale:
- New — Unworn, with all original tags, packaging, and documentation.
- Like New — Worn minimally with no visible signs of use; includes original packaging.
- Excellent — Light signs of wear; well maintained and in outstanding condition.
- Good — Moderate signs of wear consistent with regular use; fully functional.
- Fair — Noticeable signs of wear or minor imperfections; functional but visibly used.
CollectDXB does not guarantee any specific resale value for items, whether purchased, consigned, or sold through the Platform.
Our authentication opinion represents our professional assessment based on available information and expertise. While we exercise the highest standards of care, authentication is inherently an opinion-based process.

10. Intellectual Property

All content on the Platform, including but not limited to photographs, product descriptions, text, graphics, logos, icons, and software, is the property of CollectDXB or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Platform without the prior written consent of CollectDXB.
By submitting content to the Platform (including photographs, descriptions, and other materials related to sell requests or consignments), you grant CollectDXB a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating, promoting, and improving the Platform.
Third-party brand names, trademarks, and logos displayed on the Platform are the property of their respective owners. Their use on our Platform is for identification purposes only and does not imply endorsement or affiliation.

11. User Conduct

When using the Platform, you agree that you will not:

Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
Submit fraudulent sell requests, consignment submissions, or purchase orders, or misrepresent the authenticity, condition, or provenance of any item.
Use automated tools, bots, scrapers, or other software to access, monitor, or copy any content from the Platform without our prior written consent.
Interfere with or disrupt the integrity or performance of the Platform, its servers, or its connected networks.
Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or any systems or networks connected to the Platform.
Harass, abuse, or harm another person, or engage in any conduct that is threatening, defamatory, or otherwise objectionable.
Upload or transmit viruses, malware, or any other harmful code that could affect the operation of the Platform.

CollectDXB reserves the right to investigate and take appropriate action against any user who violates these conduct guidelines, including suspension or termination of their account and referral to law enforcement authorities.

12. Limitation of Liability

To the fullest extent permitted by applicable law, CollectDXB's total liability to you for any claims arising out of or related to your use of the Platform or any transaction conducted through the Platform shall not exceed the purchase price of the item in question.

CollectDXB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses.
CollectDXB is not liable for the actions, omissions, or conduct of any third party, including but not limited to payment processors, shipping carriers, or other users of the Platform.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
CollectDXB does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

13. Indemnification

You agree to indemnify, defend, and hold harmless CollectDXB, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of or access to the Platform.
Your violation of these Terms or any applicable law or regulation.
Your violation of any rights of a third party, including intellectual property, privacy, or proprietary rights.
Any content you submit, post, or transmit through the Platform, including sell request submissions, consignment materials, or communications.
Any fraudulent, misleading, or inaccurate information you provide regarding the authenticity, condition, or provenance of any item.

This indemnification obligation shall survive the termination of your account and these Terms.

14. Dispute Resolution

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United Arab Emirates.

The courts of Dubai, UAE shall have exclusive jurisdiction over any disputes arising from or related to these Terms or your use of the Platform.
Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct communication and negotiation.
A party wishing to raise a dispute must provide the other party with written notice describing the nature of the dispute and the relief sought. The parties shall have a period of 30 days from receipt of such notice to attempt resolution before either party may pursue formal legal action.
Nothing in this section shall prevent either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction where necessary to protect their rights or interests.

15. Modifications

CollectDXB reserves the right to update, modify, or replace any part of these Terms at any time at our sole discretion. Changes may be made to reflect updates to our services, legal requirements, or operational practices.

We will notify you of material changes to these Terms via email to the address associated with your account or by posting a prominent notice on the Platform.
Your continued use of the Platform following the posting of any changes constitutes your acceptance of the revised Terms.
If you do not agree with the modified Terms, you must discontinue your use of the Platform and close your account.
It is your responsibility to review these Terms periodically to stay informed of any updates. The "Last updated" date at the top of this page indicates when the Terms were most recently revised.
